Why do you need Legionella Control?

Legionella control is vital for businesses to prevent the growth and spread of Legionella bacteria within their water systems. Exposure to contaminated water can cause the potentially fatal Legionnaires’ disease (a form of pneumonia) even from just small droplets of contaminated water.

Regular Legionella risk assessments, routine water system monitoring and adhering to ACOP L8 and HSG274 legal regulations are crucial steps to be taken for reducing the risk of legionella. Businesses following these steps maintain safe water systems, protect public health and fulfil legal health and safety compliance obligations. Failure to do so can result in penalties, including fines, as well as risks to the health of employees and visitors.

Legionella Compliance

  • ACOP L8 outlines the core legal requirements for controlling Legionella bacteria and water hygiene standards. Demonstrating compliance with ACOP L8 is widely recognised as evidence of meeting legal duties.

The person responsible for your water systems must follow these 5 basic principles:

    1. Identify and assess sources of risk.
    2. Prepare a written scheme for controlling the risk.
    3. Implement, manage and monitor precautions.
    4. Keep records of precautions.
    5. Appoint someone to be managerially responsible.

We make sure your risk assessments, records, and routines follow ACOP L8. It’s a strong way to evident that your site is safe.

  • HSG274 provides practical guidance on controlling Legionella risks in water systems. We use this guidance to keep your testing, monitoring, and maintenance compliant, effective, and up to date.

The Health and Safety at Work Act 1974 (HSWA), Control of Substances Hazardous to Health Regulations 1999 (COSHH) and Management of Health and Safety at Work Regulations 2002 (MHSWR) state that there are guidelines which must be followed to protect employees and the public from the risks associated with Legionella.

Water Hygiene Compliance & Legal Regulations

Whenever water is stored or used in a way that may create a foreseeable risk of exposure to Legionella bacteria, there is a legal responsibility to assess, manage and prevent the risks of Legionnaire’s disease.

If you are a duty holder such as a landlord or employer responsible for premises, you must comply with your obligations under Health and Safety legislation. At VW Compliance, our reports and records are designed to meet the required standards for inspections, ensuring you have the evidence needed to demonstrate compliance and keep your water systems safe.

  • Next, we carry out a straightforward Legionella risk assessment in line with ACoP L8 and HSG274 guidance. We then carry out a detailed review of your systems, including taking water temperatures and water sampling where required, to flag any areas that need our attention and confirm system safety in line with ACoP L8 and HSG274.

  • You receive a clear, easy-to-follow report that outlines all findings, risk levels, and any recommendations, along with a practical plan of the steps needed to keep your water system safe, compliant, and well managed. These reports can be kept for inspection or your own records.

Frequently Asked Questions

  • Legionella is a type of bacteria that’s spread through contaminated water droplets. This bacterium is usually spread in areas of warm, stagnant water, such as water tanks, showers, air conditioning systems and humidifiers. The bacteria are more commonly spread in public places like schools, care homes or leisure facilities and areas where water is left to stand for long periods.

The presence of Legionella in water can lead to Legionnaires’ disease in some cases, with the most common strain being Legionella pneumophila. Carrying out regular Legionella testing and risk assessments is important to keep your premises from the risk of a spread.

  • Yes, a Legionella risk assessment is mandatory. Under UK health and safety legislation, including the Health and Safety at Work Act 1974 and COSHH, duty holders- such as employers, building owners, and landlords- must assess and control the risk of exposure to Legionella bacteria in their water systems.

  • A Legionella risk assessment involves a detailed review of your water systems to identify conditions that could encourage the growth of Legionella bacteria and highlight any areas requiring control measures or corrective action. Conducted in line with ACoP L8 and HSG274 guidance, the assessment helps ensure your systems remain safe, compliant, and effectively managed.

Contact our team today to arrange your Legionella risk assessment and ensure your property continues to meet current UK health and safety compliance requirements.

  • Legionella risk assessments and Legionella testing are two different things. Confuse them, and you could be wasting money, or worse, putting the public at risk.

A Legionella risk assessment is a legal requirement. It’s about identifying potential hazards in your water system, evaluating the risk, and putting controls in place to prevent Legionella growth. Every property manager or business owner must ensure this happens, whether you manage a single property or an entire portfolio.

Legionella testing, on the other hand, It involves taking water samples and checking if Legionella bacteria are present. Unlike risk assessments, testing is not always required. In fact, in most low-risk residential properties, it’s unnecessary unless there’s a specific reason to suspect contamination.

  • Yes. UK legislation requires duty holders to assess and manage Legionella risks in water systems. Compliance with ACoP L8, HSG274, COSHH, and the Health and Safety at Work Act helps protect occupants, prevent Legionnaires’ disease, and meet legal obligations.

  • The bacteria multiply where temperatures are between 20-45°C and nutrients are available. The bacteria are dormant below 20°C and do not survive above 60°C.

  • Water systems should typically be cleaned and disinfected at least once a year, or more frequently if your risk assessment identifies higher risks.

Certain situations also require immediate cleaning and disinfection, including:

    • After system installation, refurbishment, or significant plumbing work

    • When water quality results show contamination, such as elevated bacterial counts

    • If a system has been unused or stagnant for an extended period

    • Following a Legionella outbreak or detection

Regular cleaning is essential to prevent the build-up of scale, biofilm, and debris, all of which create ideal conditions for bacteria, including Legionella,to grow. The exact frequency should always be guided by your site-specific water risk assessment and current UK compliance standards.
